If any provision of these Terms of Use is determined to be invalid by any law, rule, decree or regulation of any government or by the final determination of any state or federal court, such invalidity shall not affect the enforceability of any other provision of the Terms of Use. Failure by LYNRED to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
